Terms & Conditions

These Terms & Conditions (“Terms”) govern the provision of services and use of the Nine Meadows website, located at ninemeadows.com (“Site”), and form part of every service agreement between Nine Meadows (“we,” “us,” “our,” or “Contractor”) and the client (“you” or “Client”).
By booking services or accessing this Site, you agree to these Terms.
1. Services Provided
Nine Meadows provides landscaping, garden design, installation, consultation, maintenance, and related ecological design services (collectively “Services”). All Services are provided only after a signed proposal and/or service agreement between Client and Contractor is executed.
A detailed proposal or contract describing the scope of work, deliverables, timeline, payment terms, and any additional terms shall be provided to the Client prior to commencement of work.
Nine Meadows does not provide medical or mental health services. Any references to wellness or well-being reflect environmental and lifestyle benefits of nature based design.
2. Estimates & Quotes
Estimates, proposals, and quotes are valid for 30 days from the date issued unless otherwise specified in writing. Any changes in project scope may require a revised estimate or additional charges.
3. Payments
Clients agree to pay all amounts set forth in the proposal or service agreement. Payments are due according to the schedule described in the proposal. Unless otherwise noted in your contract, any Services not paid within 15 days of invoicing may incur a late fee or service suspension.
Sales Tax: Landscaping services are considered taxable retail services under Kentucky law, and applicable sales tax will be added to invoices and remitted by Nine Meadows in accordance with Kentucky taxation requirements .
4. Cancellations & Changes
Clients may request cancellation of scheduled Services with at least 48 hours’ written notice. Cancellations received less than 48 hours before a scheduled Service may incur a cancellation fee equal to a portion of the scheduled labor and preparations.
Changes to the Scope of Work after set design approval, ordering of materials, or equipment allocation may result in additional charges and require a contract amendment in writing.
5. Client Responsibilities
Clients agree to:

Provide accurate site information and access to the property during scheduled work times.

Communicate any site hazards, underground utilities, or special access concerns prior to work.

Ensure that any structures, irrigation systems, utilities, or sensitive plantings unlikely to withstand installation activities are disclosed.
6. Limitation of Liability
To the fullest extent allowed by applicable law, Nine Meadows shall not be liable for indirect, incidental, consequential, special, or punitive damages — including loss of use, loss of profits, or loss of plants or materials — arising from delays, weather conditions, site conditions, or unforeseen circumstances affecting plant performance or installation results.
Nothing in these Terms shall limit liability for death, personal injury, or any other liability that cannot be excluded under Kentucky law.
7. Warranty & Performance
Nine Meadows provides no implicit or express warranty on living plant material beyond initial installation quality unless otherwise specified in your service agreement. Plant performance may vary based on weather, maintenance, site conditions, and seasonal factors beyond our control.
8. Termination
Either party may terminate a service agreement by providing written notice if the other party materially breaches this Agreement and fails to cure within 14 days of receiving written notice.
9. Force Majeure
Neither party is liable for delays or failure to perform due to events beyond reasonable control, including acts of nature, weather, strikes, government regulation, or delays of suppliers.
10. Use of Website
Your use of this Site is subject to these Terms and our Privacy Policy. You agree not to misuse the Site or interfere with its operation. All content (text, images, logos) is the property of Nine Meadows and protected by intellectual property laws.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Kentucky. Any dispute arising under these Terms shall be resolved in the courts of Kentucky.
12. Acceptance of Terms
By booking our Services or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions
